March 2020 Issue - COVID-19 Edition

Dear colleagues,

As the COVID-19 situation continues to rapidly evolve, we want to make you aware of resources available to you. In these unprecedented times, we are all trying to figure out the best course of action as conditions and recommendations change hourly. We know that communicating with patients and taking care of your staff is a primary concern.

The latest news and resources from the PCSO is posted at https://www.pcsortho.org/covid-19-information-for-your-practice/. You can also find up-to-date news and resources from the AAO at https://www1.aaoinfo.org/covid-19/

These are uncertain times for all of us to say the least. I do take some comfort, however, in knowing we are all in this together. Please reach out if you have thoughts or questions.

Wishing you health and wellness,
Robert Meister, DDS, MS
PCSO President

TODAY: AAO to sponsor CARES Act Webinar
Steven Dickerson and James Van Orden from Cozen O'Connor Public Strategies will present a webinar for AAO members on what the CARES Act means to small businesses and their employees on Monday, March 30, 2020 at 4:00pm PT. AAO members should register immediately for this timely update on how to navigate small business issues during COVID-19 related closures and restrictions.
Coronavirus Frequently Asked Questions
The American Dental Association (ADA) has an FAQ list with answers here. Some of the questions include:
  1. What should employee dentists do when their employer refuses to close offices per ADA or state guidance?
  2. What is business interruption insurance and can it help cover this risk?
  3. I’m a new dentist and am barely working because of the COVID-19 pandemic. My financial situation is very tight: can I postpone making payments on my student loan until I'm working again?
  4. Should I refinance my student loans while interest rates are lower?
  5. My practice revenue has dropped because of the COVID-19 pandemic. I’m not sure how we’re going to meet fixed expenses, pay my staff and take an income to support my own family. Does the federal government have a program to help small businesses, like dental practices, that have been financially impacted by the pandemic?
The AAO has also put together a list of frequently asked questions which you can view here.

California Board of Dentistry Files Motion to Dismiss SmileDirectClub Claims
On December 23, 2019, the California Board of Dentistry filed a motion to dismiss the claims brought against it by SmileDirectClub and Dr. Jeffrey Sulitzer (SmileDirectClub's Chief Clinical Officer) in the federal court for the Central District of California. The claims arise out of an investigation by the Board into SmileDirectClub and Dr. Sulitzer in California, which resulted in an Accusation (formal complaint) filed by the Board against Dr. Sulitzer in November 2019.

The Board alleges that Dr. Sulitzer, in overseeing SDC "SmileShops" in California, reportedly committed violations of California's dental laws, apparently including, but not limited to, use of fraud in the procurement of fictitious name and additional office permits, use of advertisement tending to deceive or mislead the public, treatment of patients not of record, and aiding and abetting the unlicensed practice of dentistry.

In addition, At-Large Trustees are nominated and elected by the Board of Trustees, have voting rights, and bear all the responsibilities of a Trustee. These individuals will be appointed for one three-year term.

In order to ensure the proper vetting of candidates is done prior to the 2020 House of Delegates, applications are due by January 17 with board interviews to occur on February 15. It is the hope of the board, that the new At-Large Trustee(s) would begin their term on May 5, 2020 in Atlanta.
