As 2019 wraps up, so does the count for HIPAA breaches this year. The US Department of Health & Human Services Office for Civil Rights (OCR) is finalizing settlements and crunching numbers for end-of-the-year reports. Many of the large settlements were due to the following:
  • failure to provide breach notifications
  • lack of business associate agreements
  • failure to conduct a risk analysis
  • lack of access and audit controls
  • failure to utilize device and media controls
  • lack of encryption
  • failure to restrict access to protected health information

Big Dollar HIPAA Settlements of 2019

Back in November, Google announced they were going to purchase Fitbit for over $2 billion dollars. They had been eyeing the fitness tracker giant for a while and hoped to be more competitive in the market with big money makers, like Apple. Many have already voiced concerns with privacy issues and worry that Google will have access to sensitive health information. The DOJ is looking into this deal while HHS and federal lawmakers question how Google will collect and use this personal health information.

SC Medicaid Requirements

South Carolina has been approved by the federal Centers for Medicare and Medicaid Services to require eligible Medicaid applicants to show that they are currently working, volunteering, or involved in job training 80 hours a month before being admitted to Medicaid. S.C. is the 11th state to receive approval to add work requirements, but one of the few to require that applicants already be working. Several states have had their work requirements blocked or suspended, while others have held off on implementation.
