Ordinance 144 Section 308 Garages
Approximately 6 months ago concerns were brought to the attention of Borough Council regarding garages being constructed on lots without a home. Council felt the concerns were valid and the current Ordinance 144, Section 308 should be reviewed. A request was sent to Planning for the review. Planning then researched the current section of the Ordinance, and with input from the community, decided that changes were needed. Those changes required discussion and research which Planning felt would take considerable time to accomplish.
Due to that fact, Planning decided to recommend to Council that the construction of garages on lots without a residence be restricted until a complete review was completed. In January, Ordinance 189 was voted and enacted restricting the construction of garages, thus allowing Planning time to perform a complete review. After much research and discussion Planning presented an amended Ordinance to Council at the May 12th regularly scheduled meeting. Planning felt this version addressed the concerns with the previous Section 308. Council reviewed, conducted a Public Hearing, and unanimously voted to approve the amended version as presented by Planning at that meeting. Since that time, Council's vote was vetoed. The veto was substantiated with additional concerns based upon certain wording contained in the proposed Ordinance and the potential for unintended consequences. Council decided not to override the veto at its May 26th public meeting but, instead decided to direct our Solicitor to prepare a revised amendment for further consideration. Ordinance 189, Section 308, which restricts the construction of garages on vacant lots will therefore stay valid until the additional review can be completed, a new Public Hearing can be held, and a final decision can be made.
